This Limited Extended Warranty acts as an extension of the Original Warranty provided by the Affiliate of 3 years or 36,000 miles. In the first 36 months or 36,000 miles after service work is performed, Customer must assert any warranty claim to the Affiliate under the terms and conditions of the Original Warranty. The Limited Extended Warranty shall then be in effect for an additional 24 months or 24,000 miles, whichever occurs first, after the expiration of the Original Warranty of the Affiliate. Mileage will be calculated off of the vehicle’s odometer reading at the time of service as noted above by Administrator.


This Limited Extended Warranty is made available only to you as the owner of the vehicle indicated on the invoice and is not transferable to any subsequent owner. This Limited Extended Warranty only applies to parts and labor listed in the attached insert purchased from Administrator. Customer supplied parts installed at the option of the Customer carry no warranty and likewise, there is no warranty covering the labor for the installation of said parts.


In the event, the vehicle suffers a breakdown within 25 miles of Administrator’s facility located in Moorhead, Minnesota or Fargo, North Dakota, whichever was the original repair facility, Customer must return the vehicle to Administrator for this Limited Extended Warranty to apply. Outside of the 25-mile radius, Customer can take the vehicle to another repair shop; however, Administrator must be contacted before any service work is
performed under the terms of this Limited Extended Warranty and Administrator must give prior written consent to the work being performed. Said written consent shall not be unreasonably withheld.

Any applicable roadside assistance only applies pursuant to the terms of the Affiliates Original Warranty. Administrator is not offering any roadside assistance pursuant to the terms of this Limited Extended Warranty. With the lifetime of this Limited Extended Warranty, in the event repairs are needed, it shall be the Owner’s sole responsibility to arrange for the vehicle to be transported to Administrator during regular business hours or to another location if the breakdown occurs outside of the 25-mile radius as described above.

The Administrator warrants that the above repairs and services performed at their location will be free from defects in materials and workmanship for an additional 24 months or 24,000 miles of use, whichever comes first, beyond the term of an Affiliate’s Original Warranty, measured from the date first repair and the odometer reading shown on the original repair invoice. This warranty is conditioned on the vehicle being subjected only to normal, non-commercial use, and receiving reasonable and necessary maintenance during the warranty period. Warranty repair Costs shall in no case exceed the costs of the original repair or service. If there is a defect in either materials or workmanship within
the warranty period, the Administrator has the option to perform remedial service work at no charge to you, replace the defective warranted part(s) without charge to you or refund the entire charge for the warranted repairs, minus any previous refunds.

A purchaser of covered products or services has the right to have warranty service performed during the warranty period. The warranty period will be extended for the number of whole days that the vehicle has been out of the buyer’s hands for warranty repairs. If a defect within that warranty period, the warranty will not expire until the defect has been fixed. The warranty period will also be extended if the warranty repairs have not been performed due to delays caused by circumstances beyond the control of the buyer, or if the warranty repairs did not remedy the defect and the buyer notifies the Administrator of the failure of the repairs within 60 days after they were completed, If after a reasonable number of attempts, the defect has not been fixed, the buyer may return his/her for a replacement of parts, if applicable, or a refund, in either case, subject to deduction of a reasonable charge for usage. This time extension does not affect the protections or remedies the buyer has under any law.


You must pay for any non-warranty service you order to be performed at the same time as any warranty service. This warranty will not apply to your repaired vehicle if it has been damaged by abnormal use, misuse, neglect, accident, alteration or “tampering with” (by other than the Administrator or Administrator’s employees). The Administrator’s employees and/or agents do not have the authority to modify the terms of this warranty, nor to make any promises in addition to those contained within this warranty.

This warranty does not cover repair(s) or service(s) except as listed in the attached insert “What does this Limited Extended Warranty cover?”, even though the Administrator may offer other services. Specifically excluded are any internal engine, transmission, clutch, differential repairs, all gaskets, all seals, internal transfer case repairs, all diesel repairs, turbochargers/superchargers, used parts or assembly replacement of the same. Also excluded are auto body, paint, molding, tires and glass repairs. Commercial vehicles are excluded.


You must keep a copy of the original repair invoice and present it when seeking service under this Limited Extended Warranty. If warranty work is to be performed, you must temporarily surrender possession of the original repair invoice or a legible copy of the same. If you are within 25 miles from the original Repair Facility, then you must return your vehicle to the Repair Facility for any warranty repairs at your own cost. If you are more than 25 miles from the original Repair Facility, then you must call the Administrator prior to any warranty repair work being performed at 218.477.0696 (Moorhead), 701.478.3838 (Fargo), 701.282.5305 (South Fargo) or 701.356.2988 (Collision Center) from 8:00 AM to 6:00 PM Monday through Friday, excluding holidays. The Administrator will guide you to the nearest facility where it will authorize work to be performed. If there are no participating locations in your area, you may take your vehicle to a non-participating facility in your area. If the non-participating Repair Facility will not accept payment from the Administrator, you must pay for the warranty service and submit your original repair invoice (or legible copy) and subsequent warranty repair invoice (or legible copy) to the Administrator for review, within 90 days of the date to repair.


In order to keep your Limited Extended Warranty valid, you must follow the maintenance procedures listed below. If your failure to follow these procedures causes a Breakdown, you may be denied coverage.

You must have your vehicle serviced in the following manner every six (6) months or six thousand (6,000) miles, whichever comes first:

1. Check engine oil and filter;
2. Check PCV valve operation;
3. Check and maintain power steering fluid level;
4. Check and maintain transmission fluid level;
5. Check and maintain drive axle fluid level;
6. Lubricate front suspension; and
7. Check and maintain the proper level of coolant.

In accordance with Manufacturer’s prescribed service intervals you must; change transmission fluid, drive axle fluid and brake fluid. Follow all other recommendations of the manufacturer regarding other special services (if applicable to your model) as outlined in the Owners Manual. You must keep receipts which verify the Vehicle Identification Number, work orders and other documentation that shows date, a description of your vehicle, mileage and services performed. Administrator may require to furnish the Administrator with proof that the specific services have been performed. Failure to show proof that all scheduled maintenance repairs have been performed may void coverage under this Limited Extended Warranty.

We recommend you return to the Administrator for all scheduled maintenance. We are committed to ensuring your vehicle is properly maintained and we will also retain copies of your maintenance records in order to assure your compliance with maintenance record retention. Most repair facilities will not retain copies of your maintenance records for more than a couple of years.


We recommend that you return your vehicle to the Administrator for repairs covered under the Affiliate Original Warranty and this Limited Extended Warranty.

Use all reasonable means to protect your vehicle from further damage. Return your vehicle to the Administrator for covered repairs. Authorize the Repair Facility to perform necessary diagnostic work and provide “teardown authorization” so that the repair facility can provide an accurate diagnosis and estimate of repairs. IMPORTANT: WE WILL NOT PAY FOR DIAGNOSIS CHARGES FOR REPAIRS NOT COVERED UNDER THIS LIMITED EXTENDED WARRANTY. If this work is to be performed at a location other than Matt’s Automotive, you must first obtain written authorization to obtain the same. Furnish the Administrator with such information as they may reasonably require, and if requested, provide proof of your vehicle’s regular maintenance during the Limited Extended Warranty Period as defined in the Maintenance Requirements section.

Allow the Administrator to examine your vehicle if asked to do so. All repairs being authorized by the Administrator prior to beginning any repairs covered by this Limited Extended Warranty. Call the following business day to receive claim filling instructions should a breakdown occur on a weekend or holiday. Customer service hours are 8:00 AM to 6:00 PM Monday through Friday.


You are responsible for making sure the oil warning light/gauge and temperature warning light/gauge are functioning before driving the vehicle. You are required to safely pull your vehicle off the road and shut down the engine immediately when the oil warning light/gauge or the temperature warning light /gauge indicates a problem.


Administrator’s liability hereunder, if any, shall be strictly limited to the original cost repair or to replace any covered Breakdown not to exceed the original repair costs; but, in no event shall this cost exceed the average retail value of your vehicle as determined by the NADA (Official Used Car Guide) at the time of loss.


All Implied Warranty which may arise under state law, including all Implied Warranties of Merchantability or Fitness for a particular purpose, are limited to the duration of this Limited Extended Warranty and do not cover incidental or consequential damages. Some states do not allow limitations on how long an Implied Warranty lasts or the exclusion of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.


If the Affiliate, part manufacturer, or any other repair facility agrees to cover all or some of the cost a Breakdown after a warranty or guarantee has expired, Administrator will pay only for any extra cost.


Your help and cooperation is required if we ask you to help us enforce your rights against any manufacturer or repair facility who may be responsible to you for the cost of repairs covered by this Limited Extended Warranty.


If we pay for a loss, we may require you to assign to us your rights to recovery against others. We will not pay for a loss if you impair these rights to recover. Your rights to recover from others may not be waived.


If either party brings against the other party any proceeding arising out of this Limited Extended Warranty or a disagreement of costs, that party may bring that proceeding only in the Seventh Judicial District of Minnesota, Clay County, and each party hereby submits to the exclusive jurisdiction of said court for purposes of any such proceeding.

Agreement Date meaning the date you executed the Limited Extended Warranty.

Breakdown meaning the failure of any original or like replacement part covered by this Limited Extended Warranty to perform its intended function(s) in normal service, providing it has received all scheduled maintenance as recommended by the manufacturer in the Owner’s Manual. Breakdown does not include the gradual reduction in operating performance caused by wear and tear where a failure has not occurred.

Cost meaning the reasonable and customary charges for the parts and labor necessary to repair or replace the parts covered. These charges shall not exceed the manufacturer’s suggested retail price for the parts and labor allowances derived from national recognized labor time publications.

Original Warranty meaning the 36 months or 36,000 mile warranty provided to Customer by an Affiliate. This limited warranty is extended only you, the original purchaser, and not anyone who may purchase your vehicle from you during the term of the warranty. This limited warranty is made by the Independent Repair Facility (”Facility”) who is so named on the original repair invoice and performed the service/repairs on your vehicle. This warranty may be honored by other Facilities participating in this program, or authorized non-participating facilities anywhere in the United States.
